Topic Description:
The applicant is seeking
Preliminary Plat approval to divide one parcel of
approximately 16.7 acres into four (4) lots, ranging in size
from + 2.3 acres to + 6.95 acres. Each lot
will be served by well and drainfield.
The applicant has also
requested that Subdivision Ordinance Section 10-6 be waived,
eliminating the requirement for separate construction
drawings. This action has not been the standard practice of
the Planning Commission and Board of Supervisors; however,
in some instances a modification of the Final Construction
Plan may be warranted. In this case, the Preliminary
Plat/Final Construction Plan submitted to our office
includes all necessary items as required by both plan
categories. A copy of the Preliminary Plat/Final
Construction Plan is included as Attachment 1. A copy
of the Applicant’s Statement of Justification related to the
Waiver Request is included as Attachment 2.

Location, Zoning and
Current Land Use:
The
±16.7
acres are zoned Rural Residential (RR-2). Adjacent
properties in all directions are also zoned Rural
Residential (RR-2). The property is located west of the
intersection of Old Mill Road (Route 602) and Razor Hill
Road (Route 637), in the Cedar Run District.

Requested Action of the Board
of Supervisors:
No action is necessary,
unless a majority of the Board wishes to consider this
preliminary subdivision application. On February 28, 2008,
the Planning Commission voted unanimously to approve the
Stribling’s Mill Estates Preliminary Plat and Waiver of
Subdivision Ordinance Section 10-6 subject to the following
conditions:

The Final Plat shall
be in general conformance with the Preliminary Plan/Final
Construction Plan titled "Stribling’s Mill Estates” dated
June 22, 2007, last revised December 14, 2007, signed by
James R. Ashley on February 11, 2008.

A note shall be added to
the Final Plat which states, “Fauquier County does not
certify as to the relative integrity of the existing dam
and associated pond structures and assumes no liability
should the existing pond embankment or outfall structure
fail in any way, shape or form.

The following language
shall be added to the Final Plat and Deed of
Subdivision: “The owners of Lots 3, 4 and the future
administrative lot comprise the physical ownership
interest of the existing pond. They collectively and
equally share all financial and civil liability
associated with the existing pond and shall hold
Fauquier County harmless of any event occurring therein
or within or around the existing pond.”

Language shall be added
to the Deed of Subdivision regarding the upkeep of the
area located within the Pond Maintenance Easement.
