Subdivision Ordinance Text Amendments to Sections 9-5 (Preliminary Plan Requirements) and 10-5 (Final Plat Requirements) to Require Inclusion on Preliminary Plans and Final Plats of Mapped Dam Break Inundation Zones

Topic Description:

The Code of Virginia (§15.2-2258) now requires preliminary plans and final plats to include mapped dam break inundation zones.  This state code change was a companion to changes to §10.1-606.2 of the Code of Virginia, which also required the mapping of certain dam break inundation zones.  The proposed Subdivision Ordinance text amendment requires that any dam break inundation zone which is required to be mapped by §10.1-606.2 be included on preliminary plans and final plats.  §10.1-606.2 further requires such maps be filed with the Virginia Department of Conservation and Recreation and the County; therefore, Community Development staff will need to develop internal procedures to verify compliance with this Ordinance change.

Planning Commission Recommendation:

The Planning Commission held a public hearing on this item on May 28, 2009.  No members of the public spoke.  The Planning Commission unanimously recommended approval.

Conduct a public hearing and consider adoption of the attached Ordinance.
