A Resolution Authorizing the
County Administrator to Enter Into Contracts for the
Improvement of Roads Within Bethel Academy Subdivision for
Inclusion on the Virginia Department of Transportation’s
State Secondary System of Highways

Topic Description: |
|
The roads within the Bethel
Academy Subdivision are not within the Virginia Department
of Transportation’s State Secondary System of Highways.
Since the development of the subdivision, the roads within
the subdivision have been maintained by the developer. The
developer is now elderly and wishes to discontinue
maintenance of the roads. As a result, ownership of the
roads within Bethel Academy Subdivision have been
transferred to and are currently titled in the name of the
Bethel Academy Homeowners Association. More than fifty-one
percent (51%) of the residents of the Bethel Academy
Subdivision have petitioned the Board of Supervisors to
create a special taxing district to fund the necessary
improvements to the Bethel Academy Roads to permit them to
be taken into the State Secondary System of Highways. The
residents have requested that the Board of Supervisors
advance the funds to make the necessary improvements to the
roads in order to permit the roads to be taken into the
State Secondary System of Highways at this time. At a
previous work session on this issue, the Board of
Supervisors determined to advance the funds necessary to
improve the roads in Bethel Academy and to permit them to be
taken into the State Secondary System of Highways. The Board
of Supervisors also determined that the advanced funds would
be repaid through the imposition of a special taxing
district on the residents of Bethel Academy whose lots are
served by the roads. The Board of Supervisors determined
that the repayment terms for the advanced funds shall be on
a 10-year repayment schedule, principal only with no
interest. The cost to improve the roads is estimated at
less than $600,000.00. It is requested that the Board
authorize the County Administrator to enter into contracts
for the construction of such improvements to the Bethel
Academy Subdivision and the management of said construction,
so as to permit the roads to be taken into the Virginia
Department of Transportation’s State Secondary System of
Highways. |

Financial Impacts Analysis: |
|
Up to $600,000 in advanced
funds to be repaid by the residents of Bethel Academy
Subdivision through the imposition of a special taxing
district. The tax rate leveled would be sufficient to
guaranty the repayment of the advance funds on a 10-year
repayment, principal only with no interest. Funds to be used
will come from the County’s utility fund to be repaid over
the 10-year period. |
