The County of Fauquier is
required by law to provide for the free public education of
its citizens residing within its boundaries including those
citizens residing in the towns of Remington, The Plains and
Warrenton, The Plains and Remington. The cost of providing
for public education include the capital costs associated
with the construction, operation and maintenance of public
elementary, middle and secondary schools located in the
County of Fauquier. The County of Fauquier and the Towns of
Remington, The Plains and Warrenton fall within the
authority set forth in Virginia Code Section 15.2-2298 to
accept certain voluntary proffers of cash and the dedication
of real estate to address the capital impacts of development
which have a reasonable relationship to the request to amend
the zoning map of the locality. The County of Fauquier and
the Towns of Remington, The Plains and Warrenton have,
within their respective ordinances, adopted provisions
related to the voluntary proffering of cash and the
dedication of real property where the need for such proffers
arise for the rezoning request. The County of Fauquier is
desirous of entering into agreements with the Towns of
Remington, The Plains and Warrenton evidencing the Towns’
intent to request proffers of cash and real property from
applicants for rezoning to help defray the capital costs of
public educational facilities serving, or planned to serve,
the area for which the rezoning is requested.

Consider adoption of the
attached resolution.
