ORDINANCE

AN ORDINANCE TO APPROVE REZONING REQUEST #rezn08-LE-001,

Wexford village LEE DISTRICT

            WHEREAS, Wexford Mews, LLC, owner and applicant, has initiated an application to amend the Fauquier County Zoning Map in accordance with the provision of Zoning Ordinance Section 13-202 to rezone approximately 9.81 acres (PIN 6899-24-0759-00 & 6899-25-0237-000) from Residential (R-4) to Commercial - Highway (C-2) to permit a mixed use development of neighborhood commercial use; and

            WHEREAS, on October 25, 2007, the Fauquier County Planning Commission held a final public hearing on the rezoning request; and

            WHEREAS, on January 10, 2008, the Fauquier County Board of Supervisors held its final public hearing on the rezoning request and considered both oral and written testimony; and

            WHEREAS, the Fauquier County Board of Supervisors has determined that the proposed rezoning is in conformance with the Fauquier County Comprehensive Plan; and

            WHEREAS, by the adoption of this Ordinance the Board of Supervisors has determined that the public necessity, convenience, general welfare, or good zoning practice is satisfied by this rezoning; now, therefore, be it

            ORDAINED by the Fauquier County Board of Supervisors this 10th day of January 2008, That rezoning request #REZN08-LE-001, Wexford Mews, LLC, to change the Zoning Map designation of approximately 9.81 acres Residential (R-4) to Commercial Highway (C-2), be, and is hereby, approved, subject to the Conceptual Development Plan prepared by Carson-Ashley dated July 13, 2007, last revised October 29, 2007, and with the Proffer Statement, dated July 13, 2007, last revised November 19, 2007.
