A Resolution
to Delete a Final Plat Condition Imposed by the Board of
Supervisors in 1986 for Cool Springs Estates
|
|
Topic
Description: |
|
Cool Springs
Estates, a three lot subdivision in Lee District fronting on
Route 17, was approved in 1986 by the Board of Supervisors
with the condition that there be one entrance onto Route
17. The subdivision was instead constructed with two
entrances and the proposed single entrance was impractical
to construct. The Virginia Department of Transportation (VDOT)
has no objection to the deletion of the condition and
William Walther, one of the property owners, was permitted
to construct an entrance directly to Route 17. A 1991 plat
of partial vacation of the single-entrance easement recorded
in deed book 659 at page 1579 imposed the following
limitation: “all lots to share a common entrance except that
lot 29(A) may have a separate entrance so long as owned by
Walther.” Should the Board adopt the attached resolution,
the notation is no longer necessary. |
