The applicant had an approved
Special Exception from July 20, 1993 that granted a decrease
in non-common open space for the division of property into
two (2) lots. However, the time frame for the Special
Exception lapsed and the applicant did not record the
divisions, but now wants to do so. Prior to approving this
division, the applicant needs to submit the Special
Exception again for approval. This application requires
minimal review and has not changed. Therefore, staff feels
that the request for no fee assessment for this submittal is
reasonable.
The division of this property is to
settle an estate that has been pending since the early
1990s. The two lots in the application are RA zoned lots
and are also specifically limited by the language on the
Special Exception Plat to agricultural uses only. The
division of property will result in two (2) lots showing one
25-acre lot and one 29.2981 acre lot. A condition requiring
deed restriction on both lots will prohibit further
subdivision.
