RESOLUTION

A Resolution overturning the Director of Community Development’s Determination Regarding the Brookside Communities, LLC, Request for Construction Plan Approval (Cases: CPRV09-SC-005 and SPMA09-SC-010) and the Identified Deviations

WHEREAS, Brookside Communities, LLC, is the owner of property subject to the approved Brookside Farm Planned Residential Development (PRD) Proffer Statement and Modifications to the Zoning Ordinance (PR01-S-02), Preliminary Plat and associated conditions (PP01-S-08); and

WHEREAS, the developer has filed construction plan (CPRV09-SC-005) and site plan (SPMA09-SC-010); and

WHEREAS, the developer filed requests for construction plan and deviations approval on September 1, 2009; and

WHEREAS, the Director of Community Development issued a letter of determination on October 8, 2009, that the collective changes represented in the referenced construction plan and requested deviations are substantial enough to warrant official amendments to the Brookside Concept Development Plan and Preliminary Plat needing Board of Supervisors approval; and

WHEREAS, Brookside Communities, LLC, filed an appeal on November 2, 2009 regarding the Director’s determination letter; and

WHEREAS, the Board has considered the staff information and Director’s determination, as well as the Applicant’s presentation; now, therefore, be it

RESOLVED by the Fauquier County Board of Supervisors this 14th of January 2010, That it overturns the determination of the Director of Community Development and finds the collective deviations to be in substantial conformance with the approved 2002 Preliminary Plat and Concept Development Plan.
