Applicant is requesting the Board of Supervisors
approve his claim of $10,300,000
in damages. Applicant
alleges that the Board's actions denying his rezoning request and
removing property owned by him from the Bealeton Service District,
as part of the Board's amendment of its Comprehensive Plan, were
arbitrary and capricious, violated good zoning and planning
practices were taken in violation of Virginia Code §15.2-2232,
2239, 2286(7) and 2204, and violated both the Virginia
Constitution and the Constitution of the United States.
