Topic Description: |

The Code of Virginia
permits localities to charge an administrative fee on
persons with delinquent taxes or other delinquent charges.
The Board has imposed that administrative fee by adopting
Section 8-38 of the Code of Fauquier County relating only to
the collection of taxes. This fee has now been increased.
Currently Section 8-38 does not contain a provision to
charge the administrative fees for collection of other
delinquent charges, nor does it contain provisions to
recover collection agency's fees or attorney's fees, or a
provision to charge administrative costs for the collection
of nuisance abatement liens.
The proposed Ordinance
renames Article XIII to Court Costs and Administrative
Fees and amends Section 8-38 of the Code of Fauquier
County to permit the County to charge administrative fees
for collection of delinquent taxes or other delinquent
charges consistent with Virginia Code Section 58.1-3958; to
provide for the recovery of collection agency's fees or
attorney's fees; and to impose administrative costs for the
collection of nuisance abatement liens.

|
The Ordinance amendments
will result in an increase in the fees collected subsequent
to the filing of a warrant or other appropriate legal
document but prior to judgment, and a higher fee for taxes
or other charges collected subsequent to judgment, allows
for partial recovery for attorney's or collection agency's
fees, and imposes administrative costs for collection on
nuisance abatement liens.
