A Resolution to APPROVE A WAIVER FOR A PRIVATE STREET THAT DOES NOT CONNECT DIRECTLY TO A STATE MAINTAINED ROAD
WHEREAS, James L. and Elsie M. Browning, owners, are seeking a waiver (WVRP09-CR-011) to Zoning Ordinance Section 7-302.1.A.2 to allow for a private street that does not connect directly to a state maintained road; and
WHEREAS, the applicants propose to create a family transfer lot, an administrative lot and a residual lot from the 15.0712 acre parcel identified as PIN 7828-69-9862-000 and a 6.0037 acre parcel identified as PIN 7828-79-6337-000, with access via an ingress / egress easement that is fifty (50) foot wide, which connects to Eskridges Lane; and
WHEREAS, On January 29, 2009, the Fauquier County Planning Commission recommended approval of the proposed Zoning Ordinance waiver, subject to conditions; now, therefore, be it
RESOLVED by the Fauquier County Board of Supervisors this 12th day of February 2009, That Zoning Ordinance Section 7-302.1.A.2 be, and is hereby, waived to permit James L. and Elsie M. Browning to create a family transfer lot, an administrative lot and a residual lot on the above referenced parcels, as illustrated on the Plat prepared by The Engineering Groupe and dated December 4, 2007 and signed by Ned Marshall, CLS on January 9, 2009 or a subsequently revised plat that illustrates the new subdivision lots, which will be accessed by an ingress / egress easement that is fifty (50) feet in width, subject to the following conditions:
2. Each of the three, proposed lots are prohibited from future construction of a Family Dwelling Unit, Efficiency Apartment, or Guest House as defined by the Fauquier County Zoning Ordinance, or any other dwelling unit aside from one, single-family dwelling unit.
