RESOLUTION A RESOLUTION TO ADOPT AN IDENTITY THEFT PREVENTION PROGRAM IN COMPLIANCE WITH THE FAIR AND ACCURATE CREDIT TRANSACTIONS ACT OF 2003 WHEREAS, the Fair and Accurate Credit Transactions (FACT) Act of 2003 and related Federal Trade Commission Regulations require financial institutions and creditors to implement a written program by May 1, 2009 to detect, prevent, and mitigate instances of identity theft on certain accounts; and WHEREAS, government entities that defer payment for goods or services are considered creditors that must implement an identity theft prevention program; and WHEREAS, the Fauquier County Department of Environmental Services, the Warrenton-Fauquier Airport, and the Department of Parks & Recreation maintain accounts that are covered by FACT and the Federal Trade Commission Regulations; and WHEREAS, an identity theft prevention program for Fauquier County has been drafted and submitted for the Board’s approval as is required by FACT; now, therefore, be it RESOLVED by the Fauquier County Board of Supervisors this 12th day of February 2009, That the Fauquier County Identity Theft Prevention Program be, and is hereby, approved and adopted; and, be it RESOLVED FURTHER, That the County Administrator, and/or his designate, and representatives of the respective Departments affected by this Identity Theft Program be, and are hereby, authorized to take all actions necessary to implement and maintain the Fauquier County Identity Theft Program.
