RESOLUTION A Resolution to Initiate a Text Amendment to Article 7 of the Zoning Ordinance to Establish a Limitation on the Length of Cul-de-Sacs Within the Zoning Ordinance WHEREAS, street length limitations applicable to subdivisions are currently set forth in the Subdivision Ordinance; and WHEREAS, it has been determined that it is appropriate and in the interest of public safety and sound transportation policy to place such limitations within the Zoning Ordinance and to establish a mechanism within the Zoning Ordinance to obtain relief from the limitation; and WHEREAS, the Board of Supervisors has determined that the proposed text amendment is consistent with good zoning practice and in the best interest of the public; now, therefore, be it RESOLVED by the Fauquier County Board of Supervisors this 14th day of February 2008, That the Ordinance amendment set forth herein be, and is hereby, forwarded to the Fauquier County Planning Commission for its consideration. Proposed amendment: PART 4.5 7-450 PUBLIC AND PRIVATE CUL DE SAC STREET LENGTH LIMITATIONS 7-450 Public and Private Cul De Sac Street Length Limitations 7-450 No public or private cul de sac or dead end street within a subdivision created after the adoption of this ordinance shall extend to a length greater than 700 feet from an intersection, exclusive of turnaround, unless a modification is granted by the Board of Supervisors to this requirement. The Board may modify the foregoing limitation provided that the applicant can show that no other remedy is realistically feasible, that plausible alternatives have been exhausted, that to not so modify the limitation would place an unreasonable restriction on the use of the property and that properties through which access is planned will not be unreasonably affected. |
