RESOLUTION

A RESOLUTION STATING THE INTENT OF THE BOARD OF SUPERVISORS TO ISSUE REQUESTS FOR PROPOSALS ON A PUBLIC/PRIVATE PARTNERSHIP PROJECT TO CONVERT MUNICIPAL SOLID WASTE TO ENERGY AND/OR BIOFUELS

WHEREAS, the Fauquier County Board of Supervisors wishes to find a more economical and environmentally friendly method of disposing of its municipal solid waste; and

WHEREAS, the Board of Supervisors wishes to find an economical and environmentally friendly method of extending the useful life of the present sanitary landfill; and

WHEREAS, waste to energy projects appear to provide an economical and environmentally friendly way of achieving those above stated goals; and

WHEREAS, the Code of Virginia provides through the Public-Private Education Facilities and Infrastructure Act of 2002, as amended, authority to counties to enter into public/private partnerships for the purpose of constructing projects which are necessary to serve a public need and purpose; and

WHEREAS, the Board of Supervisors, by the adoption of this resolution, determines that a public/private partnership for the purpose of constructing, implementing, operating, financing and maintaining a municipal solid waste to energy facility would serve a public need and purpose; now, therefore, be it

RESOLVED by the Fauquier County Board of Supervisors this 14th day of February 2008, That the County Administrator is hereby directed to begin the Request for Proposal Proposals on a Public Private Partnership Project to Convert Municipal Solid Waste to Energy and/or Biofuels; and, be it

RESOLVED FURTHER, That the Request for Proposal shall include, but not be limited to, the following provisions indicating the Board of Supervisor’s:

  1. Willingness to supply all non-recyclable, and possibly recyclable, municipal solid waste received at the County’s sanitary landfill to the project; and
  2. Readiness to lease an approximate number of acres at a mutually agreeable location at the County’s Sanitary Landfill for the project; and
  3. Willingness to provide a mutually agreeable portion of the landfill tipping fee to the energy plant operator.
