AN ORDINANCE TO APPROVE REZONING REQUEST rezn08-LE-001, Wexford village
WHEREAS, Wexford Mews, LLC, owner and applicant, has initiated an application to amend the Fauquier County Zoning Map in accordance with the provision of Zoning Ordinance Section 13-202 to rezone approximately 9.81 acres (PIN 6899-24-0759-00 & 6899-25-0237-000) from Residential (R-4) to Commercial - Highway (C-2) to permit a mixed use development of neighborhood commercial use; and
WHEREAS, on October 25, the Fauquier County Planning Commission held a final public hearing on the Rezoning request; and
WHEREAS, on February 14, 2008, the Fauquier County Board of Supervisors held its final public hearing on the Rezoning request and considered both oral and written testimony; and
WHEREAS, the Fauquier County Board of Supervisors has determined that the proposed Rezoning is in conformance with the Fauquier County Comprehensive Plan; and
WHEREAS, by the adoption of this Ordinance the Board of Supervisors has determined that the public necessity, convenience, general welfare, or good zoning practice is satisfied by this rezoning; now, therefore, be it
ORDAINED by the Fauquier County Board of Supervisors this 14th day of February 2008, That Rezoning Request REZN08-LE-001, Wexford Mews, LLC, to change the Zoning Map designation of approximately 9.81 acres Residential (R-4) to Commercial – Highway (C-2), be, and is hereby, approved, subject to the Conceptual Development Plan prepared by Carson-Ashley dated July 13, 2007, last revised October 29, 2007, and with the Proffer Statement, dated July 13, 2007, last revised January 18, 2008.
