Appeal of the Director of Community Development’s Finding that Brookside Communities, LLC, Changes to the Concept Development Plan and Preliminary Plat are Substantial Enough to Warrant Official Amendments to the 2002 Rezoning Concept Development Plan and Preliminary Plat


Topic Description:

Brookside Communities, LLC filed an appeal to the Director’s determination that the layout of Phases 12, 13 and 15 of the Brookside development contains modifications that, taken collectively, materially alter the character of the proposed development and are not in substantial conformance with the general nature of the approved proffered map amendment. 

Status Summary:

The Developer and the Department of Community Development made presentations and responded to questions regarding the appeal at the Board of Supervisors January 14, 2010 regular meeting.  Action was postponed for 30 days.  The agenda item and supporting material for last month’s meeting can be viewed at the following location:

Since the meeting, the Developer and County staff have completed a Lake Drive Resolution for Board of Supervisors’ consideration at the February 18, 2010 meeting.  The agenda item presents changes to the construction plan that the Developer has agreed to complete, and includes a resolution that identifies an altered Lake Drive extension and associated street network with conditions and expectations.  This proposed Lake Drive Alternative would replace the Lake Drive (Option 1) approved by the Board of Supervisors on December 16, 2002.
