RESOLUTION A Resolution to DENY Colonial Crossing Rezoning REZN05-LE-014; and Special Exception SPEX06-LE-020 WHEREAS, Donald R. Tharpe, Trustee, owner/applicant, has submitted a proffered rezoning request to rezone the parcel identified as 6990-10-5075-000, currently zoned Village (V) (3.1 acres in size) and a 60-acre portion of parcel 6899-29-5691-000 (85.03 acres total size), currently zoned V and Rural Agricultural (RA), to Residential-4 (R-4); andWHEREAS the aforementioned parcels are within the Bealeton Service District; and WHEREAS the applicant seeks rezoning approval in order to construct a development of 111 single family detached dwellings; andWHEREAS this proposal requires a Category 20 Special Exception for an above-ground sewer pumping station(s) to serve the proposed development; and WHEREAS, on September 28, 2006 and October 26, 2006, the Planning Commission held public hearings on these applications and voted unanimously to recommend denial of the Rezoning request and its companion Special Exception; and WHEREAS, on March 8, 2007, the Fauquier County Board of Supervisors conducted a public hearing and considered the written and oral testimony; and WHEREAS, the Fauquier County Board of Supervisors concurred with the judgment of the Planning Commission and finds that the Rezoning request and its companion Special Exception are not warranted and the applicant has not met the Fauquier County Zoning Ordinance Standards of Article 5 and the specific standards of Section 13-200, Part 2; now, therefore, be it RESOLVED by the Fauquier County Board of Supervisors this 8th day of March 2007, That Rezoning request REZN05-LE-014 and its companion Special Exception SPEX06-LE-020, Donald R. Tharpe, Trustee, owner/applicant, be, and are hereby, denied. |
