RESOLUTION

A RESOLUTION TO AUTHORIZE THE COUNTY ATTORNEY TO SETTLE THE CASE OF NORTH FORTY ASPEN PLUS, L.P. V. THE BOARD OF SUPERVISORS OF FAUQUIER COUNTY, VIRGINIA

            WHEREAS, North Forty Aspen Plus, L.P. has two erroneous tax assessment cases pending in the Fauquier County Circuit Court (CL08-749 and CL08-750) to challenge the assessment of two parcels of property in Bealeton owned by them (PIN 6889-35-6574-000 and 6889-35-6574-000);  and

            WHEREAS, it was determined that the properties assessed to North Forty Aspen Plus, L.P. were assessed for 2006-2009 in excess of their fair market value;  now therefore, be it

             RESOLVED by the Fauquier County Board of Supervisors this 11^th day of March, 2010, That the Board of Supervisors does hereby authorize the County Attorney to settle the two erroneous tax assessment cases by executing an Order adjusting the value of PIN 6889-35-6574-000 to $7,477,000 and PIN 6899-35-8059-000 to $2,829,400 and understanding that pursuant to the Code of Virginia the Treasurer will be obligated to grant a refund of erroneous taxes paid with interest at 10% per annum.
