RESOLUTION
A RESOLUTION TO APPROVE Fauquier
Christian Church: SEAM09-CR-003 & SPPT09-CR-014 – Applicant Wishes to
Amend a Previously Approved Special Exception for an Open Space
Reduction to Change the Authorized Use and Obtain a Special Permit for
the Construction of a Place of Worship
WHEREAS, Jesse Jones Jr. and Beverly J.
Grantham Jones, Trustees, owners and Jeffrey Wickert, applicant, are
seeking a Special Exception Amendment and Special Permit in order to
construct a place of worship; and
WHEREAS, on December 10, 2008 and January 29, 2009 the Fauquier County
Planning Commission held public hearings on the proposed Special
Exception Amendment and Special Permit and unanimously recommended
approval of the application, subject to conditions; and
WHEREAS, on March 12, 2009, the Board of Supervisors conducted a public
hearing and considered written and oral testimony; and
WHEREAS, the Board of Supervisors has determined that the application
satisfies the standards of Zoning Ordinance Articles 5-006, 5-600 and
5-2600; now, therefore, be it
RESOLVED by the Fauquier County Board of Supervisors this 12th
day of March 2009, That
SEAM09-CR-003 & SPPT09-CR-014 be, and are hereby approved,
subject to the following conditions:
- This
Special Exception is granted for and runs with the land indicated in
this application and is not transferable to other land.
- This
Special Exception is granted only for the purpose(s), structure(s)
and/or uses (place of worship) indicated on the Special Exception
Plat titled Concept Plan as approved with this application, as
qualified by these development conditions.
- All
lighting shall be in conformance with the Fauquier County Zoning
Ordinance and positioned downward, inward and shielded to eliminate
glare from all adjacent properties.
- The
applicant shall comply with all applicable water and sewage
treatment standards as determined by the Virginia Department of
Health.

Drainfields shall not be located
in FEMA 100-year floodplain.

A Site Plan is required per
Fauquier County Zoning Ordinance Sections 3-306.

Stormwater management and BMPs shall be required for the site.
- The
applicant shall meet landscape and buffering requirements pursuant
to the Zoning Ordinance.
- The
maximum number of attendees at the facility shall be 255.

The entrance shall meet
minimum sight distance and entrance requirements in accordance with
the VDOT Minimum Standard of Entrances to State Highways,
including turn lane improvements, as
required.

Since public water supply is
unavailable, arrangements shall be made to comply with a nationally
recognized standard such as NFPA 1142 Standard on Water Supplies for
Suburban and Rural Fire Fighting.
- A jurisdictional
determination will be required at the Site Plan phase.
- Due to the
proposed construction on soil map units with a high shrink-swell
potential and low bearing capacity, a geotechnical study is
recommended to determine appropriate construction of roads and
foundations.
- The water supply
shall meet all Virginia Department of Health requirements for a
public water supply.
- An erosion and
sediment control plan must be developed and submitted for approval
with the Site Plan.
- Prime Farmland
shall be preserved to the maximum extent possible.
- The applicant
shall provide additional screening between the parking area and the
accessway and between the proposed church and the property
boundaries to create a visual buffer between the parking areas and
the neighboring Mennonite Church and help soften the hardscape,
complementing the rural character of surrounding development.
- The applicant is
encouraged to explore the use of passive solar heating & lighting as
well as geothermal technology for the church building.
