A RESOLUTION TO APPROVE SPEX08-LE-028, SPEX08-LE-029, AND SPEX08-LE-030:  Three Category 13 Special Exceptions to Allow for Drive-Throughs to Accommodate a Bank, Restaurant, and Pharmacy

            WHEREAS, Grace Lim and James Lim (a.k.a. In Seok Lim), owners, are seeking Special Exception permits on parcels identified as 6899-16-6332-000 and 6899-16-9374-000 to allow for three drive-throughs; and

            WHEREAS, the drive-through uses are limited to a bank, restaurant and pharmacy; and

WHEREAS, on February 26, 2009, the Fauquier County Planning Commission held the final public hearing on the Special Exception requests and unanimously recommended that the application be denied; and

            WHEREAS, on March 12, 2009, the Fauquier County Board of Supervisors held a public hearing on the Special Exception requests and considered both oral and written testimony; and

            WHEREAS, the Fauquier County Board of Supervisors determined that the applications satisfy the standards of Zoning Ordinance Articles 2-410, 5-006; now, therefore, be it

            RESOLVED by the Fauquier County Board of Supervisors this 12th day of March, 2009, That Special Exceptions SPEX08-LE-028, SPEX08-LE-029, SPEX08-LE-030, be, and are hereby, approved, subject to the following conditions:

1.      The Special Exceptions are granted for and run with the land indicated in this application as PINs 6899-16-6332-000 and 6899-16-9374-000.

  1. The plan shall comply with the provisions in Article 12 of the Fauquier County Zoning Ordinance.  Such provisions shall be reviewed with the Major Site Plan applications.
  2. Drive-through stacking spaces and drive aisles shall only be located behind or to the side of buildings.
  3. A maximum of three drive-throughs shall be allowed on the site and distributed as follows:  one restaurant, one bank and one pharmacy.
  4. All drive-throughs shall be located north of the internal public road.  No drive-throughs shall be located between buildings and Routes 17 or 28.
  5. The restaurant shall be limited to one drive-through lane, the pharmacy limited to one drive-through lane and two drive-through lanes shall be allowed for the bank.
  6. Escape lanes shall be provided for all drive-throughs unless a waiver is granted by the Zoning Office.
  7. The bank and pharmacy shall have a minimum of five stacking spaces and the restaurant shall have a minimum of seven stacking spaces.
