Currently Section 9-3 of the Subdivision Ordinance requires
an application for preliminary plan approval to be submitted
not later than forty (40) days prior to the date of the
Planning Commission meeting at which the applicant wishes
the plat to be considered. However, the Code of Virginia
(§15.2-2260(B)) allows state agencies and public
authorities, including the Virginia Department of
Transportation (VDOT), forty five (45) days in which to
complete their review. Sixty (60) days is a more realistic
timeframe in which to expect action to be taken. Staff
believes that sixty (60) days should generally be enough
time to review an application for completeness, forward it
to agencies for comments, receive comments, and prepare a
staff report.
Section 9-6 of the Subdivision Ordinance requires the
Planning Commission to render a decision on a preliminary
plat within sixty (60) days of the official filing, and this
is not proposed to change. However, when approval by a
state agency is required, Section 9-6 of the Subdivision
Ordinance, consistent with the Virginia Code, gives the
Planning Commission an additional 45 days from the receipt
of such approval to act on the plat. This is also not
proposed to change.
Planning Commission Recommendation:
The Planning Commission held a public hearing on this item
on January 29, 2009. No members of the public spoke. The
Planning Commission unanimously recommended approval.
