The proposed text amendment codifies an existing County
procedure. Currently, plats to be recorded with the Clerk
of the Circuit Court, which are not covered by the
Subdivision Ordinance, are reviewed by the Subdivision Agent
to confirm that the plat is in fact not a subdivision as
defined by the Ordinance. Examples of these types of plats
include boundary surveys and exhibit plats. In the past,
these types of plats were sometimes used to try to
unlawfully record subdivisions.
Under current County procedures, after review by the
Subdivision Agent, this type of plat is stamped with a note
that the plat has not been reviewed for compliance with
zoning and subdivision requirements and does not constitute
an approval of new lots of record under the Fauquier County
Subdivision Ordinance. Planning Division staff typically
reviews this type of plat in one to two days, and no fee is
charged for this service. With the note and Subdivision
Agent’s signature, the applicant is able to record the plat
with the Clerk of the Circuit Court.
Following adoption of the proposed text amendment, current
County procedures would remain the same.

Planning Commission Recommendation:
The Planning Commission held public hearings on this item on
December 10, 2008 and January 29, 2009. No members of the
public spoke. The Planning Commission unanimously
recommended approval.
