A SUBDIVISION Ordinance Text Amendment to Section 4-1 TO require plats not under subdivision control to be submitted to the Subdivision Agent for verification that the plat is not a subdivision
WHEREAS, on October 30, 2008, the Planning Commission initiated this text amendment; and
WHEREAS, on December 10, 2008, and January 29, 2009 the Planning Commission held public hearings on the proposed text amendment and forwarded the proposed text amendment to the Board of Supervisors recommending approval; and
WHEREAS, on March 12, 2009, the Fauquier County Board of Supervisors held a public hearing on this amendment; and
WHEREAS, adoption of the attached amendment to Section 4-1 supports good subdivision practices, convenience, and the general welfare; now, therefore, be it
ORDAINED by the Fauquier County Board of Supervisors this 12th day of March 2009, That Section 4-1 be, and is hereby, amended as follows:
4-1 Platting Required
No tract of land situated within Fauquier County shall be subdivided unless the subdivider shall cause a plat of subdivision with reference to known or permanent monuments to be made, submitted and approved pursuant to the terms of this Ordinance and recorded among the land records of the Office of the Clerk of the Circuit Court of Fauquier County. No plat of subdivision shall be recorded unless or until the plat shall have been submitted to the governing body and approved and certified by the governing body in accordance with the regulations set forth in this Ordinance. No lot shall be sold in any subdivision before the plat shall have been recorded. Any plat which is not under subdivision control shall be submitted to the Subdivision Agent for review and confirmation that the plat is not a subdivision as defined by this Ordinance.
