A Resolution to Authorize the County Administrator to Enter into a Modified Agreement with Riverside Mulch Inc. to Allow for the Payment of Fees and Connection to the Airport Sewer Facilities


Topic Description:

At its August 2007 meeting, the Board authorized an application to modify the special exception permit to allow the construction and operation of the Airport sewer system.  This application was  forwarded to the Board of Supervisors by the Planning Commission at its February meeting with a recommendation for approval, subject to conditions.  This special exception amendment and accompanying engineering work was initiated so that property owners identified in Phase II of the airport sewer plan could receive sewer service.  In particular, representatives of Riverside Mulch have worked with the County to identify sufficient drainfield area to permit service to the Phase II area. 

A prior draft agreement authorized by the Board at its October 8, 2007 meeting contemplated that the Special Exception Amendment would have been completed at a much earlier date.  The amendment to the Special Exception has required more time than originally anticipated and as such, Riverside has proposed modifications to the prior agreement to make it consistent with current circumstances.  The proposed revised agreement is attached.


Requested Action of the Board of Supervisors: 

Consider adoption of the attached resolution.

Financial Impacts Analysis:

The agreement is consistent with the existing practice that costs be charged to property owners served by the sewer system.  In addition, Riverside Mulch is incurring additional costs to make service available in a timely manner.  The proposal provides a positive financial impact to the County.
