RESOLUTION A RESOLUTION AUTHORIZING THE COUNTY ADMINISTRATOR TO ENTER INTO A FUNDING AGREEMENT WITH THE FAUQUIER COUNTY WATER AND SANITATION AUTHORITY FOR THE PURPOSE OF CONSTRUCTING THE EXPANSION OF THE VINT HILL SEWAGE TREATMENT PLANT WHEREAS, the adopted goals of the County's Comprehensive Plan include planning for necessary public facilities and utilities through public and private cooperation and establishing priorities for service implementation in the areas presently not served; and WHEREAS, currently the Vint Hill Sewage Treatment Plant, which services the New Baltimore Service District and Vint Hill, has a permitted capacity of 600,000 gallons per day; and WHEREAS, the current permit includes authorization to expand the plant to 950,000 gallons per day; and WHEREAS, the current Comprehensive Plan for the New Baltimore Service District assumes that the plant will be expanded to 950,000 gallons per day; and WHEREAS, under the new regulations from the Department of Environmental Quality, an expansion of a plant must receive a Certificate to Operate by December 31, 2010; and WHEREAS, on February 24, 2009, the Fauquier County Board of Supervisors adopted a resolution authorizing and guaranteeing payment to the Fauquier County Water and Sanitation Authority up to $6,062,130 to fund the cost to expand the Vint Hill Sewage Treatment Plant to 950,000 gallons per day capacity; and WHEREAS, the Board of Supervisors and the Fauquier County Water and Sanitation Authority are desirous of entering into an Agreement related to the funding of the cost to construct this plant expansion; now, therefore, be it RESOLVED by the Fauquier County Board of Supervisors this 12th day of March 2009, That the Board of Supervisors does hereby authorize the County Administrator to enter into a Funding Agreement with the Fauquier County Water and Sanitation Authority for the purpose of constructing the expansion of the Vint Hill Sewage Treatment Plant; and, be it RESOLVED FURTHER, That the County Administrator is hereby authorized to transfer any funding required by the agreement in advance of the County obtaining the necessary debt financing for this project from the utility fund or the capital contingency reserve in the Capital Improvements Fund subject to repayment of the reserve once the County receives its loan proceeds, up to a maximum amount of $6,062,130.
