Every four years, the citizens of
Fauquier County elect a Sheriff, a Commissioner of the
Revenue, a Treasurer, and a Commonwealth’s Attorney. Once
every eight years, the citizens of Fauquier County elect a
Clerk of the Courts. At that time, the Board of Supervisors
and newly elected Constitutional Officers agree on whether
the County will supplement the pay of the Constitutional
Officers and the employees of those officers.
Traditionally, the Constitutional Officers have agreed, in
exchange for the Board’s supplementing their pay and the pay
of their employees, to comply with the County’s financial,
travel and personnel policies including policies related to
employee conduct, discipline and termination. This year,
the Constitutional Officers have submitted a
proposed
agreement which includes compliance with the County’s
financial, travel and personnel policies with the exception
of the disciplinary, grievance, sexual harassment, equal
employment opportunity, conduct, and termination policies.
In those instances, the proposed agreement makes it clear
that the employees are “at will” employees of the
Constitutional Officers with no rights under the County’s
personnel policies as they relate to employee conduct,
discipline and termination. The proposed agreement also
provides that the County’s sexual harassment and equal
employment opportunity policies will continue to apply until
the Constitutional Officers adopt a policy for their own
offices. The proposed agreement runs from January 1, 2008,
through the four-year term of the Board of Supervisors and
those Constitutional Officers who are on a four-year term. |
