A Resolution to Approve a Waiver for a Private Street to Connect to a Private Street (WAVR08-CR-050) – Cedar Run District


Topic Description:

The owners/applicants are seeking a waiver of Zoning Ordinance Section 7-302.1.A.2, Limitations, which would allow a subdivision on a private street that does not connect directly to a state maintained road.  The property fronts on Inglewood Farm Lane, which is a private road that connects to Marsh Road (Route 17). The applicants are proposing to divide a 136.36-acre parcel into two lots, one family transfer lot of 2.5 acres and a residue of 133.86 acres. The reason for the proposed development is to provide housing for the owners/applicants’ daughter who is expecting her first child in May of 2008. As proposed, the lot would be accessed by a twenty-five (25) foot-wide ingress egress easement that would connect directly to Inglewood Farm Lane.

The subject property is zoned Rural Agriculture and Commercial Highway (RA & C-2). Approximately 2.5078 acres are located in C-2 Zoning District; and the remaining 133.854 acres are located in RA. The proposed Family Transfer Lot (2.5 acres) is on the RA portion of the property. Adjacent properties to the immediate north are zoned Rural Agriculture (RA), Industrial Park (I-1) and Industrial General (I-2). Adjacent properties to the immediate west are zoned Rural Agriculture (RA) and Commercial Highway (C2). Adjacent properties to the immediate south, and east are zoned Rural Agriculture (RA). There are currently two dwellings and several outbuildings on the property.


Attachment 1 is the proposed division showing access to the lots. The applicants’ Statement of Justification is included as Attachment 2.


The property is located on the east side of Marsh Road (Route 17) south of its intersection with Ritchie Road (Route 644), in the Cedar Run District.




Planning Commission Action:

On February 28, 2008, the Planning Commission unanimously recommended approval of the Applicant’s waiver of Section 7-302.1.A.2 of the Zoning Ordinance. The Planning Commission recommended a twenty-five (25) foot-wide ingress egress easement as opposed to the fifty (50) foot-wide ingress easement originally proposed. The applicant was amenable to this change and the subdivision plat will need to be amended to reflect the twenty-five (25) foot-wide ingress egress easement.
