A Zoning Ordinance Text Amendment to Section 5-1503 to Amend the Standards for Livestock Exchange to Allow Parking of Trucks and Trailers as an Accessory Use

            WHEREAS, on November 29, 2007, the Planning Commission initiated this text amendment; and

WHEREAS, on January 31, 2008, the Planning Commission held a public hearing on the proposed text amendment and forwarded the proposed text amendment to the Board of Supervisors recommending approval; and  

            WHEREAS, on March 13, 2008, the Fauquier County Board of Supervisors held a public hearing on this amendment; and

            WHEREAS, adoption of the attached amendment to Section 5-1503 supports good zoning practices, convenience, and the general welfare; now, therefore, be it           

            ORDAINED by the Fauquier County Board of Supervisors this 13th day of March 2008, That Section 5-1503 be, and is hereby, amended as follows:

5-1503                         Additional Standards for Livestock Exchanges

1.   The road frontage requirement shall be 300 feet on a road designated as a major collector (or higher) in the Comprehensive Plan unless the Board of Zoning Appeals finds that the type and amount of traffic generated by the facility is such that it will not cause an undue impact on the neighbors or adversely affect safety of road usage.

2.   An arena to be utilized for Livestock Business may be approved as part of a Livestock Exchange.  The arena may be utilized for other events specifically involving livestock, if such other events are specifically authorized as part of the Livestock Exchange special permit.  Any such arena shall be set back a minimum of 100 feet from all property lines, except that the Board of Zoning Appeals may reduce the setback to 50 feet upon a finding that a lesser setback is adequate given the specific layout of the arena and types of adjoining uses.

3.   The storage of trucks and trailers unrelated to Livestock Exchange business may be approved as part of a Livestock Exchange special permit.  Any area approved for storage of trucks and trailers shall be clearly designated on the special permit plan and shall be appropriately screened.
