RESOLUTION 

A RESOLUTION IN SUPPORT OF THE DESIGNATION OF REAL AND PERSONAL

PROPERTY OWNED BY FAUQUIER HERITAGE & PRESERVATION

FOUNDATION, INC., AS TAX EXEMPT PROPERTY 

            WHEREAS, Fauquier Heritage & Preservation Foundation, Inc. is the owner of real property identified as PIN 6969-68-7960-000 and have improvements built on it; and

            WHEREAS, Fauquier Heritage & Preservation Foundation, Inc. has applied for tax exempt status to the Internal Revenue Service and it has determined that Fauquier Heritage & Preservation Foundation, Inc. is exempt from federal income tax under Section 501(a) of the Internal Revenue Code as an organization described in Section 501(c)(3); and

            WHEREAS, Fauquier Heritage & Preservation Foundation, Inc., seeks to foster the historical heritage of Fauquier County, Virginia, through education, research, restoration and preservation; and

            WHEREAS, through volunteer labor, careful management, and donations of money, equipment, books and materials, Fauquier Heritage & Preservation Foundation, Inc., provides to the public a place to research and view historical materials and references related to Fauquier County; and

            WHEREAS, Fauquier Heritage & Preservation Foundation, Inc., fosters, plans and develops programs for the purpose of exhibiting the arts, crafts and other memorabilia of the historical and cultural past of Fauquier County; and

            WHEREAS, by adoption of this resolution, the Board of Supervisors certifies that it has examined the criteria set forth in Subsection B of Section 30-19.04 and to the extent its property is not used by non-charitable, historical, or cultural uses, Fauquier Heritage & Preservation Foundation, Inc. meets the criteria set forth in Article X of the Constitution of the Commonwealth of Virginia, and Virginia Code Section 58.1-3650 and 30-19.04(B)(1)0-(8), in answer to the questions:

            1.             Fauquier Heritage & Preservation Foundation, Inc. is exempt from taxation pursuant to Section 501(c) of the Internal Revenue Code of 1954; and

            2.            Fauquier Heritage & Preservation Foundation, Inc. does not hold an alcoholic beverage license; and

            3.            No director or officer is paid except to reimburse out of pocket expenses for postage or long distance phone bills for the organization; and

            4.            No part of the net earnings inures to the benefit of any individual. A portion of the services provided by Fauquier Heritage & Preservation Foundation, Inc. may be generated by funds received from donations, contributions, or local, state, or federal grants; and

            5.            Fauquier Heritage & Preservation Foundation, Inc. seeks to preserve the historic and/or architectural character of the community through the acquisition and restoration of all or a part of historically or architecturally significant properties; and

            6.            None of the home's activities will attempt to influence legislation.  The organization does not participate in, or intervene in, any campaign on behalf of any candidate for public office; and

            7.            The organization does not discriminate on the basis of religious conviction, race, color, sex, or national origin; and

            8.            The annual revenue impact to the locality of exempting the property is an estimated $1,918.00 according to the Commissioner of Revenue's Office; now, therefore, be it

            RESOLVED by the Fauquier County Board of Supervisors this 18th day of March 2002, That the Board of Supervisors does hereby support Fauquier Heritage & Preservation Foundation, Inc.'s request to the Virginia General Assembly for exemption of local property taxes, to the extent that its property is not leased or used by non-charitable, historical or cultural uses; and, be it

            RESOLVED FURTHER, That the Board of Supervisors does recommend to the General Assembly the specific classification of historical for the real and personal property owned by Fauquier Heritage & Preservation Foundation, Inc.; and, be it

            RESOLVED FINALLY, That the County Administrator be, and is hereby, directed to forward this resolution to members of the General Assembly.
