RESOLUTION

A resolution to consent to the provision of water service by the town of warrenton to the Warrenton north, llc PROPERTY IDENTIFIED AS PIN 6985-61-4023-000 AND TO AMEND THE FAUQUIER COUNTY/TOWN OF WARRENTON MASTER SEWER AND WATER AGREEMENT

WHEREAS, Fauquier County and the Town of Warrenton, have previously entered into a Fauquier County/Town of Warrenton Master Sewer and Water Agreement for the provision of water and sewer in the Warrenton Service District; and

WHEREAS, on September 25, 2001, the Warrenton North, LLC, filed a plan of subdivision for that certain twenty-two acres of a forty-seven-acre parcel of property (the Property) located in Fauquier County; which plan of subdivision is titled "Bluestone Subdivision"; and

WHEREAS, the property does not lie within the boundaries of the Town of Warrenton, but does lie within the Warrenton Service District and within the water service area for the Town of Warrenton; and

WHEREAS, Warrenton North, LLC has requested of the Town of Warrenton that it (Warrenton North, LLC) be allowed to utilize water utilities to service the Property as set forth in the Bluestone Subdivision plan; and

WHEREAS, the Town of Warrenton has indicated its capacity to provide such service to the Property; and

WHEREAS, the Town/County Liaison Committee has reviewed the request of Warrenton North, LLC; and

WHEREAS, the Property is located in the Phase 1 Service District Area as identified by the Fauquier County Comprehensive Plan; and

WHEREAS, Section 15.2-2143 of the Code of Virginia, 1950, as amended, provides that a locality may provide water service to a location under the jurisdiction of an adjacent locality with the consent of the adjoining locality; and

WHEREAS, the Fauquier County Board of Supervisors has no objection to the provision of water service to the Property in accordance with the Bluestone Subdivision plan; and

WHEREAS, the Fauquier County Board of Supervisors believes that the provision of water services to the Property in accordance with the Bluestone Subdivision plan would promote the health, safety, and welfare of the citizens in the use of the site; and

WHEREAS, the Fauquier County Board of Supervisors is willing to amend the Agreement to allow the provision of water service by the Town for Bluestone Subdivision; now, therefore, be it

RESOLVED by the Fauquier County Board of Supervisors this 18^th day of March 2002, That Fauquier County does hereby grant its consent for the provision of water services by the Town of Warrenton to the proposed Bluestone Subdivision in the County of Fauquier; and, be it

RESOLVED FURTHER, That the Chairman of the Fauquier County Board of Supervisors be, and is hereby, authorized to execute an amendment to the Master Sewer and Water Agreement between Fauquier County and the Town of Warrenton to make provision for the Town of Warrenton to serve the Bluestone Subdivision with public water service.
