A Resolution to Accept the Conveyance of Approximately Twenty Five Acres at Rappahannock Landing and To Enter Into a Development Agreement Involving the Property
WHEREAS, the County is to receive a parcel of land consisting of approximately 25 acres which was to have been the open space portion of a subdivision entitled “Rappahannock Landing” which was approved with conditions on the 10th of March, 2005; and
WHEREAS, a condition of the preliminary plat directed the conveyance of a portion of the property in conjunction with the recordation of the final plat for the subdivision; and
WHEREAS, both the owner of the property which was the Subject of the preliminary plat and the County desire that the property be conveyed in advance of the recordation of the final plat through a division along the line between the County land and the residue owned by Danforth-Remington FORMTEXT ; and
WHEREAS the parties have proposed to enter into an agreement to govern the conditions applicable to the division until a final plat for Rappahannock Landing is recorded; now, therefore, be it
RESOLVED by the Fauquier County Board of Supervisors this 10h day of April, 2008, That the Board does hereby authorize the County Administrator and the County Attorney to accept the conveyance of the park land and execute the development agreement attached to the agenda request for this resolution subject to such amendments as may be deemed appropriate to the County Administrator and County Attorney.
