Zoning Administrator

Topic Description: |

The Zoning Administrator is granted
authority, under Sections 5-008 and 5-012, to extend the
termination date of special permits and special exceptions.
The Zoning Ordinance also provides that appeals of most
decisions of the Zoning Administrator are taken to the Board
of Zoning Appeals. This proposed amendment would transfer
from the Board of Zoning Appeals to the Board of Supervisors
the authority to hear an appeal of a decision of the Zoning
Administrator to extend or not to extend the termination
date of a special permit or special exception issued by the
Board of Supervisors.

Summary Staff Report: |
|
The Zoning Ordinance grants to the Zoning
Administrator certain discretion in approving or denying an
extension to the termination date of a special permit or
special exception. Specifically, the Zoning Administrator
is to determine “whether the special permit or special
exception use still satisfies the applicable standards of
this Ordinance.” Staff believes that the entity best
positioned to review such a decision is the entity that
initially issued the special permit or special exception.
This proposed amendment would transfer from the Board of
Zoning Appeals to the Board of Supervisors the authority to
hear an appeal of a decision of the Zoning Administrator to
extend or not to extend the termination date of a special
permit or special exception issued by the Board of
Supervisors.
This proposed amendment was initiated by the
Planning Commission on January 26, 2006. The Planning
Commission voted to recommend approval on February 16,
2006. |
