A Resolution Finding the Proposed Use of the Property of Benjamin C. Gravett, Industrial Ltd. Partnership, PIN 7819-08-5767-000, for a Mulching Business to be Consistent with the Proffers Dated August 26, 1999
On December 6, 1999, the Fauquier County Board of Supervisors rezoned certain property identified as PIN 7819-08-5767-000 to the I-2 zoning district, subject to certain Proffers which included a Concept Development Plan. The property is located on Virginia Route 610 near the Warrenton-Fauquier Airport. The proffers submitted with the rezoning application excluded certain industrial uses and contained a Concept Development Plan showing four lots, each having a building located on the parcel and general usages such as "R&D" [Research and Development] or "Cont'r Office" [Contractor’s Office]. On February 19, 2004, Riverside Mulch, Inc., Contract Purchaser submitted a special permit application seeking to use all of the proffered property for a mulch business. Prior to the Board of Zoning Appeals meeting on this matter, the Zoning Administrator issued an interpretation finding that the use of the whole property for a mulching business would be inconsistent with the Concept Development Plan, which envisioned four lots with four separate uses. The applicants seek to appeal this decision and requests the Board of Supervisors find that the application for a mulching business is consistent with the proffers and Concept Development Plan.
