A Resolution Directing the County Administrator to Schedule a Public Hearing on a Proposed Ordinance Amending Chapter 15 of the Fauquier County Code to Add Sections 15-10 Through 15-10.3 Relating to Trespass


Topic Description:


The proposed resolution directs the County Administrator to schedule a public hearing on a draft Ordinance amending Chapter 15 of the Fauquier County Code to add Sections 15-10 through 15-10.3 permitting the designation of the Sheriff and his designees as "persons lawfully in charge of property" for the purpose of enforcing laws prohibiting trespassing.  Under the proposed Ordinance, a landowner could designate the Sheriff or his designees as agents of the property owner for the purpose of prohibiting another to go, or remain upon, the lands, buildings, or premises of the owner.  The Ordinance also establishes a written designation process by which the Sheriff or his deputies would be designated by the landowner as persons lawfully in charge of real property for the purpose of prohibiting trespassing. 


Requested Action of the Board of Supervisors:


Hold a public hearing and consider adoption of the attached resolution.

No financial impact is expected from this Ordinance, as it is within the discretion of the Sheriff to agree to be designated or not.
