A Resolution to Approve Special Exception SPEX08-CR-012, a Category 20 Special Exception to Allow for an Alternative Sewage System with a Discharge to Replace an Existing Failed Drainfield System

 

Topic Description:

The applicant wishes to obtain approval of a Category 20 Special Exception to allow for an individual sewage discharge system to remediate an existing failed drainfield system. This request is to serve a single family residence that the applicant currently occupies with his family. The proposed system is a Puraflo Discharge System that will discharge to an unnamed tributary of Kettle Run.  The applicant’s Statement of Justification is included as Attachment 1.

The applicants purchased their newly constructed home in 2003. One year later, they were issued a Notice of Violation from the Virginia Department of Health regarding the condition of their drainfield. The Applicants hired their own consultants to assist in the repair of their septic system  and it has since been determined that the only feasible solution is to replace the system with a discharge system. According to the Statement of Justification, project engineer, and the Virginia Department of Health, no other system is suitable for the soil types on the parcel.   In November 2007, the Board of Supervisors passed a Resolution referring this request to the Planning Commission.

The installation of this system requires approval of a VPDES Permit from the Virginia Department of Environmental Quality, as well as a Virginia Department of Health permit for the approval of the sewage treatment portion of the system. The Applicant is in the process of pursuing these permits concurrent with the Special Exception approval process.

 

Location,  Zoning and Current Land Use:

The property is located on Greenwich Road (Route 603), adjacent to the Prince William County line. The property is accessed by Jay Ray Way, a private ingress-egress easement. The parcel is zoned Rural Agriculture (RA) and contains approximately 5.8 acres.  Adjacent properties in all directions are also zoned RA.

 

Special Exception Analysis:

Section 5-2002.5 of the Zoning Ordinance requires that a Special Exception for a private individual sewage treatment system, which discharges into an open ditch or water shall be allowed only to replace an existing sewage system that is presently serving an existing use. The Virginia Department of Health has certified that the existing system poses a real or potential health threat and has provided written documentation to Fauquier County and the Applicant in January 2008 that the discharge permit is the only option on this site (Attachment 3). In approving such a system, the Board of Supervisors may establish conditions including but not limited to use, maintenance, and testing.

Site Suitability/Environment:

The site contains poor conditions for septic development.

Planning Commission Action:  

On March 27, 2008, the Planning Commission voted unanimously to  recommend approval of this Special Exception with the conditions included in the Resolution.
