RESOLUTION A RESOLUTION DIRECTING THE COUNTY ADMINISTRATOR TO SCHEDULE A PUBLIC HEARING TO CONSIDER THE ACQUISITION OF PROPERTY WITHIN THE OPEN SPACE OF SOUTHCOATE VILLAGE TO COMPLETE AN INTERPARCEL CONNECTION WHEREAS, Melvin C. Bender, an owner of approximately 45 acres which adjoins Southcoate Village Subdivision, has requested an interparcel connection between Callie Jo Court and his property; and WHEREAS, the County has considered the request and determined that it is appropriate and in the best interest of the public; and WHEREAS, the proposed interparcel connection is consistent with VDOT regulations and will result in improvements to public safety and the transportation network in the vicinity of Southcoate Village and the subject property; and WHEREAS, a portion of the property between Callie Jo Court and the Bender property is owned by Southcoate Village Homeowners Association; and WHEREAS, Southcoate Village has been unable to obtain title to the subject property through a voluntary conveyance; and WHEREAS, the County is authorized to acquire property through eminent domain for public purposes including transportation purposes, but must first conduct a public hearing prior to such acquisition; now, therefore, be it RESOLVED by the Fauquier County Board of Supervisors this 8th day of May 2008, That FORMTEXT the County Administrator be, and is hereby, directed to schedule a public hearing to consider the acquisition of the property necessary for the interparcel connection through condemnation or other means.
