RESOLUTION

A Resolution to DENY Colonial Crossing Rezoning #REZN05-LE-014

and Special Exception #SPEX06-LE-020, LEE DISTRICT

            WHEREAS, Donald R. Tharpe, Trustee, owner/applicant, has submitted a proffered rezoning request to rezone the parcel identified as 6990-10-5075-000, currently zoned Village (V) (3.1 acres in size) and a 60-acre portion of parcel 6899-29-5691-000 (85.03 acres total size), currently zoned V and Rural Agricultural (RA), to Residential-4 (R-4); and

            WHEREAS the aforementioned parcels are within the Bealeton Service District; and

WHEREAS the applicant seeks rezoning approval in order to construct a development of 95 single family detached dwellings; and

WHEREAS this proposal requires a Category 20 Special Exception for an above ground sewer pumping station(s) to serve the proposed development; and 

WHEREAS, on September 28, 2006 and October 26, 2006, the Planning Commission held public hearings on these applications and voted unanimously to recommend denial of the Rezoning request and its companion Special Exception for the following reasons:

1.      The property which is the subject of these applications has a reasonable existing use;

2.      The applicant has failed to demonstrate that the existing zoning of the subject property is no longer reasonable and appropriate;

3.      The applicant has failed to demonstrate that the proposed use is reasonable, appropriate, and consistent with the Comprehensive Plan and the Zoning Ordinance;

4.      The applications fail to satisfy the applicable standards of Zoning Ordinance and the Comprehensive Plan;

5.      The applications are unreasonable and inappropriate; and

 

            WHEREAS, on March 8, 2007 and May 10, 2007, the Fauquier County Board of Supervisors conducted public hearings and considered the written and oral testimony; and

WHEREAS, the Fauquier County Board of Supervisors concurred with the judgment of the Planning Commission and finds that the Rezoning request and its companion Special Exception are not warranted and the applicant has not met the standards of the Comprehensive Plan or the Fauquier County Zoning Ordinance; now, therefore, be it

            RESOLVED by the Fauquier County Board of Supervisors this 10th day of May 2007, That Rezoning request #REZN05-LE-014 and its companion Special Exception #SPEX06-LE-020, Donald R. Tharpe, Trustee, owner/applicant, be, and are hereby, denied.
