WILLOW CREEK: AN ORDINANCE TO APPROVE A REQUEST TO AMEND THE PROFFERS FOR A PREVISOUSLY APPROVED REZONING REZN05-CR-004, (FORMERLY GREEN SPRINGS)
WHEREAS, Angler Opal Associates, LLC, owner/applicant, have requested an amendment to the existing proffer statement related to the fifteen (15) proffered single family workforce housing units; and
WHEREAS, the parcels known as PINs 796981-27-6354-000, 6981-44-4079-000 and 6981-54-4190-000 comprise this request; and
WHEREAS, on April 26, 2007, the Fauquier County Planning Commission held a public hearing on the rezoning request and unanimously recommended that the application in its current form be denied; and
WHEREAS, due to a change of circumstances, staff recommends approval of the rezoning request to the Board of Supervisors for the following reasons:
1. The applicant has submitted new proffered conditions for workforce housing.
2. The proposal for workforce housing provisions contained in the proposed proffers is appropriate and meets the intent of the original rezoning.
WHEREAS, on April 26, 2007, the Planning Commission considered the rezoning request and recommended that the Board of Supervisors deny the application; and
WHEREAS, due to a change in circumstances; with the submittal of new proffered conditions related to workforce housing, staff recommends approval of this item; and
WHEREAS, on May 10, 2007, the Fauquier County Board of Supervisors held a public hearing on this rezoning request and considered both oral and written testimony; and
WHEREAS, by the adoption of this Ordinance the Board of Supervisors has determined that the public necessity, convenience, general welfare, or good zoning practice is satisfied by this amendment to the Fauquier County Zoning Map; now, therefore, be it
ORDAINED by the Fauquier County Board of Supervisors this 10th day of May 2007, That the Board of Supervisors concurs with the judgment of staff and finds that the rezoning request REZN05-CR-004, Willow Creek (formerly Green Springs), to amend the existing proffer statement related to the fifteen (15) proffered single family workforce housing units, be, and is hereby, approved subject to the Proffer Statement dated April 26, 2007.
