A Resolution to Deny Willow Creek: A Request to Amend the Proffers for a Previously Approved Rezoning REZN05-CR-004 (Formerly Green Springs)
WHEREAS, Angler Opal Associates, LLC, owner/applicant, applicant, has requested to amend the existing proffer statement related to the fifteen (15) proffered single family workforce housing units on the parcels identified by PINs 796981-27-6354-000, 6981-44-4079-000 and 6981-54-4190-000; and
WHEREAS, the requested application would allow the proffered contributions identified for workforce housing to be utilized, for qualified purchasers, to acquire workforce housing units located offsite (portable concept) to other areas within the county; and
WHEREAS, on April 26, 2007, the Planning Commission held a public hearing on the application and voted unanimously to recommend denial of the Rezoning request to the Board of Supervisors for the following reason:
1. The applicant’s proposal for workforce housing provisions contained in the proposed proffers is not appropriate and does not meet the intent of the original rezoning.
WHEREAS, on May 10, 2007, the Fauquier County Board of Supervisors conducted a public hearing and considered the written and oral testimony; and
WHEREAS, the Fauquier County Board of Supervisors concurred with the judgment of staff and finds that the Rezoning request is not warranted and the applicant has not met the intent of the original rezoning; now, therefore, be it
RESOLVED by the Fauquier County Board of Supervisors this 10th day of May 2007, That Rezoning request REZN05-CR-004, Angler Opal Associates, LLC, owner/applicant, be, and is hereby, denied.
