Resolution to Authorize the County to Maintain a Proposed
Trail to be Located in the Virginia Department of
Transportation Right-of-Way Along a Portion of Bear Wallow
Road, Adjacent to the Silver Cup Subdivision |

Topic Description: |

The residents of the Silver
Cup Subdivision and SYG Associates, Inc., developer, have
requested that the trail shown on the approved Final
Constructions Plan in the subdivision’s common open space be
relocated into the Virginia Department of Transportation (VDOT)
right-of-way, in order to alleviate concerns expressed by
the residents of the Silver Cup Subdivision. While County
staff and VDOT support this proposed location change, VDOT
has advised that it will not maintain the trail and will not
accept the location of the trail within the right-of-way
without an agreement from Fauquier County to maintain the
trail. If the Fauquier Board of Supervisors agrees to
assume the maintenance of the trail, the County will need to
make a permit application with VDOT. Construction of this
segment of trail by SYG will complete an essential link in
the County Trail Plan. |

On April 13, 2006, the Board
of Supervisors considered this request and postponed action
until its next regular meeting on May 11, 2006. The
applicant was to continue working with the Parks and
Recreation Department to determine a dollar amount for SYG
to contribute to the long-term maintenance of the trail.
Those discussions are continuing, and the applicant has
requested that action be postponed until the June Board
meeting. |

Financial Impacts Analysis: |
|
SYG Associates, Inc.,
developer of the Silver Cup Subdivision will contribute a
one-time lump sum monetary contribution to Fauquier County
Board of Supervisors towards the long-term maintenance of
the trail. At the preparation of this report, SYG has not
indicated the amount of the proposed lump sum contribution. |
