A Subdivision Ordinance Text Amendment to Section 2-39.3.A to Require Lots Created Through the Family Transfer Process to Have Entrances Approved by the Virginia Department of Transportation (VDOT)


Topic Description:

Section 2-39.3.A of the Subdivision Ordinance outlines the requirements for creating a lot to be approved as a Family Division.  Currently there is no Ordinance requirement that the application include an approved highway entrance serving the new lot. While an entrance permit is required in order to obtain the necessary zoning and building permits, the plat can be approved without an approved entrance location. All other divisions, including Administrative Divisions, require an approved highway entrance. Staff is aware of applications for Family Transfers where VDOT has indicated that they will deny the entrance.

The proposed text amendment requires that the highway entrance be approved by the Virginia Department of Transportation.

The Code of Virginia 15.2-2244.C allows high growth counties such as Fauquier to enact family transfer provisions subject to all requirements of the Code of Virginia and to any requirements imposed by the local governing body.

The Planning Commission held a public hearing on this item. No members of the public spoke. The Planning Commission unanimously recommended approval of this text amendment.

Conduct a public hearing and consider adoption of the attached Ordinance.
