The proposed resolution
authorizes the Chairman of the Board of Supervisors to
Execute the
First Amendment to the Agreement between Vint Hill
EDA and Brookside Communities, LLC. The
original agreement
between the Vint Hill EDA, Brookside Communities, LLC, the
County and Fauquier Lakes LP addressed the terms by which
Brookside Communities, LLC would be able to hook onto and
use the Vint Hill wastewater treatment plant. The agreement
also set forth the terms of the exhange of the Auburn Middle
School site for the 30-acre site proffered by the Vint Hill
EDA as part of its rezoning.
The Brookside rezoning
proffers required Brookside to connect its sewage treatment
system to the Vint Hill plant. Because the exact location
of the system lines on Vint Hill have not been ascertained
at this time, Vint Hill has agreed to the permit Brookside
to temporarily use its present system until the new system
is located and installed. This First Amendment to the
Agreement between the Vint Hill EDA and Brookside
Communities, LLC, evidences the terms of temporary use of
the Vint Hill sewer system. While no provisions place any
requirements on the County, it has been asked to sign the
agreement as it was a party to the original agreement. This
new agreement also has the benefit of shifting some of the
residents who are presently on the temporary pump and haul
system over to the sewer system.
