Topic:  A Resolution to Approve Special Exception  #01-S-14, 01-S-15 and 01-S-16, Brookside Development LLC and Brookside Communities LLC, Applicants

 

The applicant is proposing to develop an approximately 975-lot residential subdivision in the New Baltimore Service District on approximately 1,039 acres of land.  The assemblage of land includes the former Waterfield site (currently approved for 667 dwelling units in a PRD zoning district), along with other adjacent lands (Gerber tracts, and others referenced as the Brookside Communities, LLC) that are zoned R-1 (Residential).  The former Waterfield site is now referred to as Brookside Farm, while the R-1 land is referred to as Brookside.  

The applicant is seeking the following special exception approvals in association with their companion proposals for a comprehensive plan amendment, rezoning amendment and preliminary subdivision: 

1)      Special Exception applications to reduce the amount of open space required (Brookside),

2)      Special Exception to allow for floodplain crossings and floodplain uses (Brookside and Brookside Farm),

3)      Special Exception to allow the construction of public utility facilities (Brookside and Brookside Farm).

 

The associated proffer amendment application for the former Waterfield site is discussed under a separate public hearing agenda request item.  The applicant has also filed a preliminary subdivision plat, which is also reviewed under another agenda item. 

The applicant has requested that these combined applications be tracked concurrently through the public hearing process.  A public hearing on these cases was opened on March 18, 2002, and left open to allow for additional revisions to be made by the applicant and for additional public review and comment.  The public hearing for the special exception applications was continued and closed on April 18, 2002.

 

Requested Action of the Board of Supervisors: 

 Postpone action until after the public hearing on the proffer amendment application has been closed and a decision is made.  Should the Board of Supervisors choose to approve these special exception applications, staff recommends that such action be subject to the Development Conditions contained as attachments to this report.
