Proffer Statement

Calvin L. Ritchie, sole owner of the property identified on the tax maps of Fauquier County as PIN 7808-52-4186-000 (the “Property”), and the Applicant in the above referenced rezoning request, and their successors and assigns (the “Applicant”), hereby proffer that in the event the Property is rezoned by the Fauquier County Board of Supervisors from I-1 Conditional to the I-1 (Industrial) Zoning Classification, then the development thereof shall be in conformity with the following conditions proferred pursuant to Virginia Code Ann. § 15.2 – 2286 and § 13-202 (2) (D) of the Fauquier County Zoning Ordinance.  These conditions are voluntarily entered into by the applicant.  In the event that this rezoning is not granted, these proffers shall be deemed withdrawn, and of no force and effect. 

1.      The rezoning is for the 14.95-acre portion of the above referenced property, originally rezoned by the Board of Supervisors on March 20, 1990.

2.      The uses shall be limited to those which utilize agricultural and forestall products and shall be limited to the production of ethanol, wood pellets and other similar wood products, contractors offices, shops and material storage yards, agricultural uses identified in Section 3-318 of the Zoning Ordinance, wholesale and processing uses listed in Sections 3-315.2, 315.3 and 315.8 of the Zoning Ordinance and a meat processing facility, with retail sales associated with Category 17 use.

3.      The owner of the subject property and the Applicant in this case shall record a 50- foot right-of-way along the existing farm road that will serve as access for the custom meat processing facility, and grant access to such right-of-way to the owner/operator of the custom meat processing facility.  A deed for such right-of-way shall be recorded prior to the issuance of the occupancy permit for the custom meat processing facility. 

These proffers shall be binding on the owner and its successors and assigns.
