A Resolution to Authorize the County Administrator to Amend Executed Contract #33-09khc for the Route 605/602 Intersection Signalization and Turn Lane Improvements (Project Number 0605-030-354, C501; UPC Number: 79990)


Topic Description:

Background Information: The referenced Virginia Department of Transportation (VDOT) revenue share project consists of turn lane improvements, signalization and some curb and gutter installation pursuant to the approved construction plan and profiles for this Route 605/602 intersection.  It represents one of two VDOT Revenue Share Projects associated with Auburn Middle School, the Brookside Community and the opening of Kettle Run High School and Greenville Elementary School. The Route 605/676 project has been completed and accepted by VDOT.

At its February 12, 2009 meeting, the Board of Supervisors authorized the County Administrator to execute a contract with S.W. Rodgers Company, Inc. for $452,403 with allowance for negotiated change orders essential for project completion.  The County executed contract 33-09khc on March 04, 2009 in the amount of $461,379, work on the project started shortly thereafter.

Construction Problem Summary: The majority of the project is situated in a poorly drained soil (78A Dulles Silt Loam) that is characterized by a low bearing capacity, shallow watertable depth and a high shrink-swell potential.  The above average rainfalls this spring have saturated these soils and presented major complications to the construction efforts.  As a result, it has become necessary to remove the unusable soil (undercut) and replace it with compactable fill in order to facilitate the completion of the project.  This compactable fill will be placed in the area designed to become the new eastbound through lane and associated shoulder.  In addition, the undercutting operation has led to accelerated deterioration of the existing road surface and hence a portion of the existing road surface requires remediation efforts. The remediation will result basically in replacement of 21-A aggregate and re-pavement for the area that becomes the eastbound left-turn lane.

Members from VDOT, McDonough Bolyard Peck, Inc. (County Construction Management Consultant), Whitlock Dalrymple Poston & Associates, P.C. (County Geotechnical Engineering Consultant), S.W. Rodgers Company, Inc. (Construction Contractor), and County Staff have developed a unified construction strategy to address this condition and keep the project on schedule for completion mid-summer.  Therefore, a change to the original contract value is necessary.  To date, the County has received $199,834.09 in change orders for half of the soil replacement and existing road remediation due to the site conditions.  Construction efforts throughout the month of June will incur similar expenses to overcome this site condition.  Change orders are following standard VDOT contract guidelines for this type of site condition. There are adequate funds reserved as part of this County and VDOT project; the cost estimate for right-of-way/utility relocation and construction was estimated to be $920,840.

Per state procurement and contract modification rules, the County Attorney and Procurement Office advised the Department that no fixed-price contract may be increased by more than twenty-five percent of the amount of the contract or $50,000, whichever is greater, without the advance written approval of the Board of Supervisors.

Consider adoption of the attached resolution.

Financial Impact Analysis:

Funding for the Route 605/676 and Route 605/602 intersection improvements have been approved through the Fauquier County School Board and Board of Supervisors and established in Budget Code 4-302-081200-8310.
