A Resolution to Appoint Andrew Hushour as an Additional Fauquier County Zoning Administrator

Topic Description:

On May 8, 2008, the Board of Supervisors invested Andrew Hushour with the power of the Zoning Administrator when the Zoning Administrator is unavailable or when delegated duties by the Zoning Administrator during his tenure as Assistant Zoning Administrator of Fauquier County.  Immediately subsequent to that appointment, Kimberly A. Johnson, Fauquier County Zoning Administrator delegated all zoning enforcement duties and powers to Mr. Hushour.  The Fauquier County Circuit Court recently raised concern over Mr. Hushour’s authority to proceed as Plaintiff to enforce the Fauquier County Zoning Ordinance in enforcement litigation.  This resolution is to clarify the Board’s intent that Mr. Hushour was and is appointed as one of the Fauquier County Zoning Administrators with all authority and powers of Zoning Administrator as granted by the Code of Virginia and the Fauquier County Zoning Ordinance.

Requested Action of the Board of Supervisors: 

Consider the adoption of the attached resolution.
