A Resolution to Approve
Arlington Outdoor Education Association SPEX07-SC-012: A Special
Exception Request to Allow for the Indoor/Outdoor Technical School and
Expansion of the Learning Lab
WHEREAS, Arlington Outdoor Education Association, owner and applicant,
is seeking Special Exception approval to allow for an indoor/outdoor
technical school and expansion of the Learning lab on the parcel known
as PIN 7907-47-1045-000; and
WHEREAS, on April 26, 2007 and May 31, 2007, the Fauquier County
Planning Commission held public hearings on the proposed Special
Exception; and
WHEREAS, the Fauquier County Planning Commission recommended approval of
the application, subject to conditions; and
WHEREAS, on June 14, 2007, the Board of
Supervisors conducted a public hearing and considered written and oral
testimony; and
WHEREAS, the Board of Supervisors
has determined that the application satisfies the standards of Zoning
Ordinance Articles 5-006, 5-504 and 5-505; now, therefore, be it
RESOLVED by the Fauquier County
Board of Supervisors this 14th day of June 2007, That
SPEX07-SC-012 be, and is hereby, approved, subject to the following
conditions:

The Special Exception is granted for and runs with the land
indicated in this application and is not transferable to other land.

This Special Exception is granted only for the purpose(s),
structure(s) and/or uses indicated on the Special Exception Plat
approved with the application, as qualified by these development
conditions.

This Special Exception shall be granted for a period of ten (10)
years from the date of approval and must be renewed by the Board of
Supervisors in accordance with the provisions of Section 5-013 of
the Zoning Ordinance.

A maximum of three (3) school buses per day may visit the site. (It
is anticipated that teachers and staff may arrive in separate
vehicles.)

No more than one hundred seventy-five people (175) shall occupy the
site at any given time.

The facility may be in operation for 12 months, with the condition
that it complies with Fauquier County School inclement weather road
advisories.

During the school year, normal hours of operation for school science
programs are Monday through Friday from 9:00 a.m. to 2:30 p.m.

Summertime daytime programs shall be allowed Monday through Friday.

Daytime weekend science programs shall also be allowed throughout
the year.
-
Overnight camping events, so long as the number of attendees does
not to exceed the normal maximum number of attendees at the school,
shall also be allowed.

Staff shall be allowed on site prior to scheduled activities and
remain on site afterwards to allow for adequate preparation and
clean-up.

The AOEA shall be allowed to conduct open house events six (6) times
per year.

Camping and Open House events shall conform to all Health Department
and Emergency Services notification requirements.

Permanent structures to be used as classrooms shall be restricted to
the existing buildings on site, including the second floor addition,
as indicated on the Special Exception Plat titled “Special Exception
Zoning Application Exhibit” dated April 26, 2007. Other structures
utilized for maintenance, storage of materials used for the
education curriculum, agricultural purposes, student projects, or
temporary uses shall be allowed if they are in accord with the
applicant’s Virginia Outdoors Foundation (VOF) easement.

All lighting shall be in conformance with the Fauquier County Zoning
Ordinance and positioned downward, inward and shielded to eliminate
glare from all adjacent properties.

The applicant shall submit to the Zoning Administrator, on an annual
basis, a summary of attendance records for the events to ensure that
attendance limitations are maintained.

The applicant shall comply with all applicable water and sewage
treatment standards as determined by the Health Department.

All parking for school activities and camping must be provided on
site, and parking areas shall be no closer than one hundred feet
from any adjacent property with the exception of the historic
parking lot at the entrance to the property. The historic parking
area shall be allowed to remain in use but shall not be permitted to
increase in size.

For Open
House events, temporary offsite parking
shall be permitted on the adjacent property identified as PIN #
7907-76-3394
in the County tax records, subject to the
permission of the landowner.

All grass areas used for parking shall be mowed and maintained as to
minimize the risk of vehicle and field fires.

In no event shall fireworks, hot-air balloons or helicopters be
used.

The applicant shall require its employees and all invitees to
strictly comply with State burning laws and copies of such laws
shall be posted on site.
