An Ordinance to Approve


            WHEREAS, Donald R. Tharpe, Trustee, owner/applicant, has submitted a proffered rezoning request to rezone the parcel identified as 6990-10-5075-000, currently zoned Village (V) (3.1 acres in size) and a 60-acre portion of parcel 6899-29-5691-000 (85.03 acres total size), currently zoned V and Rural Agricultural (RA), to Residential-4 (R-4); and


WHEREAS the applicant seeks rezoning approval in order to construct a development of 95 single family detached dwellings; and

WHEREAS, the parcels are within the Bealeton Service District; and

WHEREAS, on March 29, 2007, the Fauquier County Planning Commission held a public hearing on the Rezoning request and recommended unanimously that the application be denied; and

WHEREAS, on June 14, 2007, the Fauquier County Board of Supervisors held a public hearing on this Rezoning request and considered both oral and written testimony; and           

            WHEREAS, the Board of Supervisors did not concur with the judgment of the Planning Commission; and

WHEREAS, by the adoption of this Ordinance the Board of Supervisors has determined that the public necessity, convenience, general welfare, or good zoning practice is satisfied by this amendment to the Fauquier County Zoning Map; now, therefore, be it

            ORDAINED by the Fauquier County Board of Supervisors this 14th day of June 2007, That the Rezoning request REZN05-LE-014, Colonial Crossing, to change the Zoning Map designation of 3.1 acres of V zoned property to R-4 and 60 acres of RA to R-4, be, and is hereby, approved, subject to Colonial Crossing Concept Development Plan prepared by The Engineering Groupe, Inc., titled Colonial Crossing Conceptual Development Plan, and the Proffer Statement dated June 4, 2007.
