A Resolution Directing the County Administrator to Schedule a Public Hearing on Proposed Amendment to Section 16-7 of the Fauquier County Code to Permit the Carrying of Concealed Weapons in Public Parks

Topic Description:

Section 16-7 of the Fauquier County Code prohibits the carrying of weapons in a County park.  The Virginia General Assembly has amended the Code of Virginia to restrict the ability of local governments to regulate the carrying, possession and transportation of firearms.  In so doing, the Virginia General Assembly; however, grandfathered existing ordinances.  Fauquier County Code provisions come under the grandfathering rules.  Since that time, the General Assembly has also amended its Code to prohibit the Commonwealth’s Attorney from prosecuting persons with concealed weapons when they are carrying concealed weapons in parks pursuant to a validly issued permit.  The proposed resolution directs the County Administrator to schedule a public hearing on the amendment of Section 16-7 of the Fauquier County Code to permit persons who hold valid concealed weapons permits to carry and possess concealed weapons while in public parks located within Fauquier County.  On May 19, 2003 , this matter came before the Board for consideration and was tabled until the next regular meeting, which is scheduled for June 16, 2003 .

Consider adoption of attached resolution.
