A Resolution to Approve / Deny the Request of Dominion Virginia Power to be Relieved of the Obligation Set Forth in Condition Number 3 of the Final Order of the Board Dated November  5, 2001, with Respect to Cool Lawn Farms and the Ritchie Property

Topic Description:

On March 13, 2002, Dominion Virginia Power submitted a request to be relieved from its obligation under Condition number 3 of a Final Order, adopted by the Board of Supervisors on November 5, 2001.  The Final Order related to Dominion Virginia's proposal to acquire additional right-of-way in the Southern Fauquier Agricultural and Forestal District, in order to construct a new 34.5 kv power line adjacent to an existing power line.  The Final Order provided in pertinent part: 

"Should the governing body of any other jurisdiction approving a portion of this electric line project require a less impactive method of constructing the 34.5 kv electric feeder line such construction shall also be used in this agricultural-forestal district.    Dominion Virginia Power shall have the right to apply to the Board of Supervisors to be relieved from the obligations of this condition upon a showing that the less impactive method imposed in the other jurisdiction will not result in a lessening of the impact in this jurisdiction or would be uneconomical or impractical, which decision shall be in the sole discretion of the Board of Supervisors."

Requested Action of the Board of Supervisors: 

Consider the request of Dominion to be relieved of the above-referenced condition, and grant or deny the request.  Resolutions to deny or approve the request are attached hereto.
